Abstract

The article presents a conceptual approach to determining the effectiveness of pre-trial investigation bodies through a systematic analysis of the laws of Ukraine that regulate their activities, taking into account the tasks of the criminal process, as well as the approach of the European Court of Human Rights regarding the interpretation of the effectiveness of pre-trial investigation.

An analysis of the results of the investigative units of the prosecutor's office for 2013-2017 was carried out, which indicated the desire of pre-trial investigation bodies to maintain statistical indicators at the appropriate level, which turned statistics from an auxiliary management tool into an actual goal in itself of the work of law enforcement agencies.

The analysis of scientific works, which reveal the problem of using statistical indicators to manage the effectiveness of pre-trial investigation bodies, showed that such a system has acquired a quasi-scientific definition - the "stick system". The stick system in scientific works is used by research authors exclusively in a negative sense, which means meaningless, aimless achievement of the easiest results by the system or each of its participants (investigator, investigative unit).

The article proposes an approach to determining the effectiveness of pre-trial investigation bodies as a concrete measure of reducing the level of crime (crime manifestations) in the society in which such bodies operate. At the same time, such a measure should not be abstract, but concrete, measurable and achievable.

As a result of the study, the question of finding relevant tools for measuring the level of crime (crime manifestations) in society arises. Such tools can both directly measure the number of manifestations of crime in society, and use indirect methods, in particular, measuring public opinion about the level of crime, the feeling of security among the population, the level of satisfaction of the population with the activities of law enforcement agencies.
