INTELLECTUAL PROPERTY SYSTEM IN THE CONTEXT OF A NEW PARADIGM OF ECONOMIC SYSTEMS DEVELOPMENT

In the context of the paradigm shift in the development of economic systems, intangible production is becoming an important area of the modern economy, as there is a tendency to reduce the share of material production in gross domestic product and increase the share of services. The share of intellectual capital in the structure of enterprises' assets is growing, which indicates an increase in the role, importance and significance of intellectual property. In addition, in the situation of constant changes in the current legislation in the field of intellectual property, as well as structural changes in the state system of legal protection and enforcement of intellectual property in Ukraine, the study of modern structural elements of the intellectual property system is becoming increasingly relevant.
The purpose of the article is to review and study the current structure of the intellectual property system in the context of formation of a new paradigm for the development of economic systems.
To achieve this goal, the article uses general scientific and special research methods, in particular, analysis and synthesis, induction and deduction, scientific abstraction and theoretical generalization, graphical method, and system analysis.
The article reveals the essence of the complex systemic category of «intellectual property», and considers various aspects of the interpretation of this concept, namely, as a special form of social relations, as an economic category, as a legal category, and as a branch of law. The author analyzes the intellectual property system of Ukraine and its main components, as well as the system of state intellectual property protection bodies in Ukraine and its transformation. The authors substantiate the important role played by intellectual property in the modern economic system by considering its main economic functions, namely, distribution, stimulation, innovation, stratification, system-forming, institutional and optimization functions. It is determined that the transformation of intellectual property relations is a driving force for economic progress, further economic development and forms a new level of economic relations.
